My question: WTF? Why is this the business of the ABA?
That's a serious question, BTW. The ABA increasingly is taking policy positions on a whole host of legal issues that have nothing to do with the practice of law or the profession of law. When relevant, moreover, the ABA usually takes a hard-line left-liberal position.
It's one of the many reasons I don't belong to the ABA. Why should I lend my money and name (such as it is) to an organization that consistently takes positions I would oppose on policy questions beyond the traditional scope of the organization's expertise and jurisdiction.
