Gordon Smith has details on a recent Delaware Supreme Court opinion that went out of its way to slap the Chancellor. The current fight reminds me of the way the Delaware Supreme Court seemed to go out of its way to smack around former Delaware Chancellor William Allen in cases like Time and Technicolor. The bar and media tend to focus on Chancery because it's where so much of the action takes place, which sometimes seem to promote a bit of jealousy from the folks on the Supreme Court who, as the opinion explicitly reminds us, is the court of last resort. In sum, it's an airing of dirty laundry that doesn't make the Supreme Court look good.
